Under Texas law, if a claimant of a homestead is married, the homestead cannot be abandoned without the consent of the claimant’s spouse.

    My mother is being sued by my sister through probate for my dad’s debt in my late father and my sisters company my mother is residing at a home that is not homesteaded, my brother is living in the homesteaded home and will not leave the home for my mother to move home can she file abadonment on that property and file homestead on the property that she is occupying now without probate being settled?
