As Chairperson of the National Association of Consumer Bankruptcy Attorneys (NACBA) 2010 Fall Members-Only Workshop, I am really excited about this year’s event! It will be held November 5 and 6,2010 in San Juan, Puerto Rico.I believe we have created a fabulous Workshop to meet all levels of experience from the beginner to the advanced practitioner. Plus, you have the advantage of learning from some of the best! Our very own Henry Sommer, Professor Jean Braucher, John Rao, Norma Hammes, and Billy Brewer are only some of the people that will be presenting at the Workshop.

We expanded our Basic Tract to two full days of how-to’s for attorneys new to the area of consumer bankruptcy (or for those who need a refresher!).This tract will take you step-by-stepfrom meeting the client for the first time through filing the case. In this tract you will learn what general relief is provided when filing a Chapter 7 or Chapter 13, case preparation by Bankruptcy Code sections, what to do at the client’s first consultation and what documents you need, organizing documents, Chapter 13 plan calculations, analysis of raw data, basic tax discharge rules, CMI calculation, and disposable income.

Members who have attended a number of NACBA conferences and workshops have requested more advanced topics. We listened! This year we are offering sessions on lien stripping of unsecured mortgage liens (Lien Stripping I and Lien Stripping II), small business Chapter 13 issues, how to value a sole proprietorship, how to collapse a business entity so that a Chapter 13 can be filed, debt cancellation, preventing sale of property to pay tax liens, and proper application of prior-case payments in re-filed Chapter 13 cases.

Our third tract is for practitioners who want to learn practical trial skills and an understanding of bankruptcylitigation. For those of you familiar with Max Gardner and Pete Barry’s Ultimmate BootCamp, a mini-version of this bootcamp is being presented. Although, Max will not be able to attend due to his upcoming surgery, Pete will be there with bells on! Max has graciously given us his materials to use in this session. Johnie Patterson, an attorney from Houston, Texas who has taken on the mortgage bad-guys withexcellent results, will be heading up this session with Pete Barry, Tara Twomey, Thad Bartholow, Karen Kellett, Rex Anderson, and Ron Wilcox. They will do actual scenarios with a real judge presiding and will cover depositions, discovery disputes, and much, much more!

Also, for the first time, we will have an Orientation session for members who are attending their first NACBA event or who want to learn more about the benefits of NACBA.

The entire resort has been reserved for the NACBA workshop. The Rio Mar offers eleven food outlets, private beach, kids club, casino, golf, tennis, jogging course, spa, and fitness center. The Water Sports Hut offers Wave Runners, Kayaks, Waterbikes, Windsurfers, Sailboats, and complimentary beginners sailing clinics. A rain forest is located next to the resort! Everyone should have a wonderful time, learn lots, and make new friends!
