There is pending legislation to change Chapter 13 to allow consumers to re-write their mortgages to lower the mortgage value to the value of the home, and change the interest rate.

I have had clients with their homes foreclosed even though they were current with their payments, and filed Chapter 13 bankruptcies to stop that foreclosure sale.
Why would there be a foreclosure on a mortgage for which all the payments were made?
Messed up books.
The RESPA (Real Estate Settlement and Procedures Act) provides a remedy.

Consumers increasingly are falling behind on car loans, credit cards, home equity loans, as well as mortgages.

The prime cause of the boom in foreclosures, Adjustable Rate Mortgage adjustments increasing payments beyond what the owners can afford, continues to worsen.
Current Bankruptcy law does not deal with this problem.

One of our Detroit Judges predicted more asset cases for Chapter 7 trustees, because the personal property exemptions changed to a maximum of $475 per item, 11 USC 522 (d)(3).

Chapter 13 bankruptcy attorneys hear it all the time.
Desperate people call days before the foreclosure sale, saying they just found out the mortgage company was going ahead with the sale, thought they had been talking about a forbearance agreement, working out a way to make up missed payments.
