I am sitting in 341 meetings all day today. So far several debtors have brought their very young children to the meeting. These debtors are also getting upset because they believe that they should go first and are not. Now the children are in melt down mode and it is miserable for everyone. 341 meetings are required under the Bankruptcy Code in order for you to obtain a discharge. It is critical that the meeting go smoothly so that you may obtain that discharge.The hearing room is not a playground and the other people are not babysitters. I cannot blame the child for being bored because these meetings are boring most of the time. However, if you are constantly telling the child to be quiet or sit down how in the world can you concentrate on the question that the trustee is asking?
You should receive ample notice of when your 341 meeting will be to allow you to seek out child care. Do yourself and your child a favor by arranging for someone to watch your child during this meeting so that you may actively listen and respond to your trustee. In some cases I know there is no way that child care can be arranged. If this is you, plan accordingly. Let your attorney know so we can inform the trustee, although many times it will not make a difference. Bring toys for goodness sake. Quiet toys mind you but bring something for them to occupy their time.
Did I mention these meetings are boring especially for kids? You might also consider bringing snacks (not anything messy) and a light sweater or jacket as the rooms are usually freezing. You could be sitting there for 3 hours before your case is called. If you are fidgety and bored after 15 minutes of sitting think of what your child feels.
Remember that knowledge is power and the more knowledge you have about what your 341 meeting is going to be like the more power you will have to ensure a smooth meeting with your trustee.
