Filing Bankruptcy: First Steps
By Douglas Jacobs, California Bankruptcy Attorney on May 3, 2009 in Bankruptcy Practice and Procedure, General Bankruptcy Information
The first thing to do if you are wondering about filing bankruptcy is to speak with a competent, qualified, consumer bankruptcy attorney. You can find one through this site or from the National Association of Consumer Bankruptcy Attorneys.
Then set up an appointment with the Attorney. In many cases, the first consultation is free. If it isn’t free, it will often go towards the filing and preparation fees for the bankruptcy anyway. This of course can vary depending on your location.
The first appointment with the attorney is usually a general discussion of your assets and liabilities and a discussion of what kind of bankruptcy, if any, is right for you. Some attorneys will want you to come prepared with documents or forms filled out. Some attorneys will have you provide that information further along in the process. In any event, bring with you any foreclosure notices, lawsuits or other legal documents.
And try to leave your anxiety at home. Most consumer bankruptcy attorneys are empathetic caring individuals. We would find a more lucrative way to make a living if we didn’t care about our clients. So, remember when you make that first appointment, that you have taken the first step to resolving the financial burdens that are haunting you.
