Today’s Atlanta Journal Constitution contained an interesting article entitled “Complaints Pile Up Against Debt Collectors.” Apparently the Georgia Governors’ Office of Consumer Affairs has received multiple complaints about collection tactics used by Hanna & Associates, a Marietta, Georgia collection firm.
The Governor’s office launched an investigation but Fred Hanna has no intention of cooperating. “We don’t feel like they’re entitled to anything. Period,” says attorney Hanna. His firm opens 50,000 new debt files each month and he contends that the consumer office has no right to review hundreds of thousands of files. Hanna further contends that because his office is a law firm, it is outside the consumer office’s jurisdiction.
The Governors’ Office of Consumer Affairs has served an investigative demand notice on Mr. Hanna’s office asking for documents about the firm’s collection practices including those involving zombie debt. A hearing is scheduled for March 30, 2009 in Cobb County Superior Court
