Are The 2008 Rebate Checks An Asset?
By Rachel Lynn Foley - Kansas City, MO Bankruptcy on Mar 4, 2008 in Bankruptcy Practice and Procedure, General Bankruptcy Information, Missouri
The Government has now finalized the 2008 Rebate Checks decision. Are they an asset? In a word, yes. You will need to check with your attorney as to how the rebate checks will be handled if you are currently in a bankruptcy or if you are contemplating filing a bankruptcy.
In the Western District of Missouri and in the District of Kansas, Kansas City Division, you do not have to turn over your rebate checks if you are in a Chapter 13. However, it is unclear as to how the Chapter 7 Trustees will be addressing this issue.
