Know Your Pennsylvania Bankruptcy Judge’s Judicial Practices and Procedures - Part Three: Western District of Pennsylvania

When appearing before a Pennsylvania bankruptcy judge, it is important to not only to be familiar with the Federal and local rules of procedure, but also to check the preferences of the judge before whom you are appearing.

In the Western District of Pennsylvania, the general website is http://www.pawb.uscourts.gov/.  There are five bankruptcy judges in the Western District of Pennsylvania.  They are Chief Judge M. Bruce McCullough, Judge Judith Fitzgerald, Judge Thomas P. Agresti, Judge Jeffrey A. Deller, Judge Warren Bentz, and Judge Bernard Markovitz.

Chief Judge McCullough’s page provides contact information, a staff listing, as well as his preferences for communication with the court and clerks, procedures for the chambers, settlement agreements and stipulations, and forms.  At this time, Judge McCullough provides one form, his standard Trial Order and Notice.

Judge Fitzgerald’s page provides contact information, a staff listing, as well as a list of Chapter 13 hearing dates, her Chapter 12 and 13 procedures, examples of Chapter 13 pleadings and forms, her Chapter 7 and 11 procedures, examples of Chapter 7 and 11 pleadings and forms, as well as rules for communication with Judge Fitzgerald and her staff.

Judge Agresti’s page provides contact information, a staff listing, as well as a list of Chapter 13 hearing dates, procedures for all of Judge Agresti’s cases, form orders to be used in his cases, and alphabetical index to the local rules, as well as rules for communication with Judge Agresti and his staff.

Judge Deller’s page provides contact information, a staff listing, as well as a list of Chapter 13 hearing dates, procedures for his chambers, form orders and miscellaneous documents to be used in Judge Deller’s cases, examples of forms, and rules for communication with the Judge and his staff.

Judge Bentz’s page provides contact information, a staff listing, as well as a link to his self-scheduling calendar, rules for communication with the Judge and his staff, Judge Bentz’s procedures, as well as his telephone hearing procedures.

Judge Markovitz’s page provides contact information, procedures for communication with the Judge and his staff, and procedures for using CM/ECF.
