The debt collection regulations of the Massachusetts Division of Banks limit the number of times a debt collector can call a consumer in Massachusetts. A debt collector can not communicate with a consumer at home via a telephone call initiated by the debt collector more than twice in each seven-day period. A debt collector can not communicate with a consumer at a place other than their home via a telephone call initiated by the debt collector more than twice in each 30-day period. The regulation does not specify what counts as a communication, but likely an actual conversation or a voice mail message would be a communication. A phone call that wasn’t answered and did not result in a voice mail message would almost certainly not count as a communication. This regulation is regularly violated by debt collectors.
