Don’t Believe Everything You Read! Mail Solicitation Of Debtors In Bankruptcy.

Two things that you can expect about your mail after you file for bankruptcy: Threatening letters from credit card companies, collection agencies and attorneys should stop, and all sorts of other solicitations will start.
Besides offers of high interest credit cards, you will also get offers for credit counseling and financial counseling.
For example, a client of mine in New Orleans recently received a postcard that stated the following:
IMPORTANT RE: U.S. TRUSTEES FILING
TIME SENSITIVE
Your filing with the Court was successfully recorded on August 28, 2007. BAPCPA now requires that you complete a Financial Management Course. You can complete this process in about two hours through the online course offered by ________________.
I have a couple of problems with this postcard.
First, people living in the New Orleans area do not have to undergo either credit counseling or financial counseling based upon a decision by the U. S. Trustee’s Office that counseling services are not feasible for the area post Hurricane Katrina. So, this solicitation is for a service that my client does not need.
Second, the solicitation was designed to, and did, give my client the incorrect impression that it is from the U.S. Trustee’s Office.
Be careful about the offers you get in the mail. If you have any doubt about whether or not they are legitimate, contact your attorney.
It can save you both time and money.
