Getting Help Filling Out Form 22 Of Your Bankruptcy Papers

The US Trustee, the government agency that oversees all bankruptcy case filings, issued a nine page summary interpreting Bankruptcy Form 22C, the form that is used to calculate Current Monthly Income and Disposable Income in Chapter 13 bankruptcy cases. Disposable Income is the amount of money a debtor must pay to unsecured creditors. This summary comprises the official US Trustee position on the line by line method of completing this crucial bankruptcy document, which determines how much a debtor must pay in a Chapter 13 case.
The summary can be found on the US Trustee website.
This release by the US Trustee comes on the heels of a soon to be announced modification of Form 22 by the Bankruptcy Rules Committee, a group appointed by the United States Supreme Court. A publication and comment period is expected to begin in August, with implementation of recommended changes to the Form sometime in December. Early reports by committee members are that the new version more accurately tracks the statutory language of the Bankruptcy Code.
