Foreclosure in Florida and how to manage it.

Foreclosure in Florida is filled with land-mines.  Florida allows for judicial foreclosures and an unrepresented and unsophisticated homeowner is facing an uphill battle if they want to work out a reasonable solution during the foreclosure process.  The lender’s attorney or law-firm holds all the cards in this situation, and therefore, it is best for the home-owner to obtain counsel from the beginning, even before the foreclosure process begins.  Aggressive representation is the home-owner’s best chance of obtaining a workout agreement that meets the home-owner’s needs and budget.  Counsel for the home-owner needs a clear understanding of his client’s current financial situation to determine what the best course of action will be.  Accordingly, be ready to provide your attorney with information concerning your debts, income, assets and expenses.  If you have multiple debt problems, do not dismiss the thought of filing for bankruptcy, as it provides a forum to resolve almost all debt problems and the benefits of a discharge.
