If My Creditor’s Keep Calling Me After I File For Bankruptcy Can I Record The Telephone Call?
By Kevin Gipson, New Orleans Bankruptcy Attorney on Mar 4, 2007 in General Bankruptcy Information, Louisiana
You filed for bankruptcy and your creditors keep calling in spite of the fact that you have told them to stop. Can you record the telephone call?
The answer will depend upon the state in which you live.
Some states prohibit recording of telephone calls unless all participants consent. Others, like my state, Louisiana, allows recording if you are a party to the call.
Does your state permit recording? The Reporter’s Committee for Freedom of the Press website has a State-by-State guide, “Can We Tape”.
If you are considering taping your calls, consider discussing this with your attorney before you start.
