[...] The lawsuit alleges that the defendants employed such illegal collections tactics as impersonating attorneys and state officials, threatening arrest and collecting excessive fees. “Debt collection agencies should never resort to threats or intimidation as the means by which funds are eventually collected,” said Attorney General McCollum. “Consumers under financial burdens deserve our protection and consideration, not the predatory nature of these allegations.” [...]

I too sometimes encounter surprised looks when I inform people that failure to miss a credit card payment or two will not lead to immediate incarceration or a criminal indictment. As long as you are honest and sincere in your financial dealings, you are not committing a crime.

My clients are frequently concerned that they might be thrown in jail if they don't pay their credit card bills. I explain that we outlawed debtor's prison well over 200 years ago in this country. There is nothing criminal about simply not paying your debts.

[...] Over at the Bankruptcy Law Network, a group blog in which I participate with some very smart consumer bankruptcy attorneys all over the country, I’ve just posted about debtors who are told by collection agencies that if they file for bankruptcy they’re somehow committing a crime. It never ceases to amaze me - the depths to which some unscrupulous collector types will sink in order to grasp just one more dollar. Filed In: Bankruptcy, Elsewhere in Other Blogs [...]
